Obtaining a death certificate

The death of a loved one is the most difficult test. Moreover, when a person dies in a temporarily occupied territory, the relatives and friends of the deceased actually cannot issue a death certificate.

In accordance with paragraph 2 of part 1 of Article 317 of the Civil Procedure Code of Ukraine, an application to establish the fact of death of a person in the temporarily occupied territory of Ukraine, determined by the Verkhovna Rada of Ukraine, can be filed in court by relatives of the deceased or their representatives (lawyers).

In the case of remote registration of a death certificate (through a lawyer), the procedure consists of two stages.

FIRST STAGE.
I, as your lawyer, am applying to the appropriate court in the controlled territory of Ukraine with the necessary package of documents to establish the fact of the death of a person in the temporarily occupied territory of Ukraine (Melitopol, Berdyansk, Primorsk, etc.).

In court, the case of establishing the fact of death in the temporarily occupied territory is considered by the court without delay from the moment the corresponding application is received by the court.

The court, after checking all the documents, makes a decision in which it notes that the person died in a certain period of time and in a certain area.

SECOND PHASE.
Based on the received court decision, I contact the DRATS department and register the fact of the person’s death and receive a state-issued death certificate.

In the future, I will send the original death certificate by carriers to your city or in another way convenient for you.
